Terms of Service
These Terms of Service (“Terms”) govern your use of Highlit (“the App”), developed by Tomoi. By downloading or using the App, you agree to these Terms.
1. The App
Highlit is a free app that lets you import, organize, and manage reading highlights from Kindle and Kobo devices, and add your own manually. Your reading content is stored locally on your device, and the App does not require an account. Highlit may use limited analytics and crash/error reporting to help us understand usage and improve reliability.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal, non-commercial use, subject to these Terms.
3. Your Content
Any content you import or create in the App (highlights, notes, book information) remains yours. We do not claim ownership of your content, and Highlit does not upload your reading content to our servers. The App may send limited technical or usage information through its analytics and crash/error reporting services, but these services are not used to collect your book content or highlights.
You are responsible for ensuring you have the right to import and store any content you add to the App, including highlights sourced from books or documents you do not own the copyright to. The App is a personal organization tool; it is your responsibility to use imported content in accordance with applicable copyright law.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or modify the App except as permitted by applicable law
- Use the App for any unlawful purpose
- Attempt to disrupt or interfere with the App’s normal operation
5. No Warranty
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the App will be error-free, uninterrupted, or that imported data will be parsed with perfect accuracy. We use analytics and crash/error reporting to help identify problems and improve the App, but this does not guarantee that every issue will be detected or resolved.
6. Limitation of Liability
To the maximum extent permitted by law, Tomoi shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of or inability to use the App. Since your reading content is stored locally on your device, you are responsible for backing up any content you wish to preserve.
7. Changes to the App or These Terms
We may update the App or these Terms from time to time. Continued use of the App after changes to these Terms constitutes acceptance of the updated Terms. Material changes will be reflected by an updated “Last updated” date above.
8. Termination
You may stop using the App at any time by uninstalling it. We may discontinue the App at any time, though since the App is fully offline, any version already installed on your device will continue to function independently of any such discontinuation.
9. Governing Law
These Terms shall be governed by applicable law without regard to conflict of law principles, unless otherwise required by the law of your jurisdiction.
